President Signs CPSIA Amendment into Law, Ending Ban on Youth OHVs

President Obama has signed H.R. 2715 into law, putting an end to an unintentional ban on youth ATVs and off-highway motorcycles that has lasted for more than two years. The new law amends the Consumer Product Safety Improvement Act (CPSIA) to categorically exclude youth ATVs and dirtbikes from the lead content provisions.

House and Senate Pass Lead Law Exemption for Youth Powersports

The House and Senate have passed a bill to make it easier for manufacturers and retailers of children’s products to comply with heightened lead limits in the Consumer Product Safety Improvement Act (CPSIA). In particular, the legislation included a provision to exempt youth-based off-road vehicles, such as ATVs, snowmobiles, motorcycles from the lead limits.

MIC Endorses New Legislation to Stop Lead Ban on Youth OHVs

The Motorcycle Industry Council (MIC) has announced its support for, and urged quick passage of, the “Enhancing CPSC Authority and Discretion Act of 2011” (ECADA). The discussion draft of the bill, released by Rep. Mary Bono Mack (R-CA), would end the ban on youth-sized all-terrain vehicles, motorcycles and snowmobiles caused by the unintended consequences of the Consumer Product Safety Improvement Act.

CPSC Terminates ATV Action Plan for SunL Group Youth ATVs

The U.S. Consumer Product Safety Commission (CPSC) recently announced the termination of the All-Terrain Vehicle (ATV) Action Plan for SunL Group, Inc., of Irving, Texas. As of March 30, 2011, importers and distributors cannot import or distribute any ATV subject to the SunL Group ATV Action Plan. The company was an importer and distributor of gas and electric scooters, dirt bikes, ATVs and go-karts.

Lead Testing Requirement For Youth ATVs Delayed Until November

The Consumer Product Safety Commission (CPSC) has decided to hold off on requiring third-party testing and certification of youth-sized all-terrain vehicles (ATVs) for lead content until Nov. 27, 2011, the All-Terrain Vehicle Association (ATVA) reports.
